SteadyTemp App – Terms of Use
1. Scope and Applicability
These Terms of Use (“Terms”) govern the use of the SteadyTemp mobile application (“App”) provided by SteadySense GmbH, Johann-Schreiner-Strasse 3, 8074 Raaba-Grambach, Austria (“SteadySense”, “we”, “our”, “us”).
The App is intended for private use by lay users for the purpose of measuring their or their relative’s body temperature using the SteadyTemp Patch (“SteadyTemp Patch”,“Patch”), a wearable temperature sensing patch.
By installing or using the App, the user (“you”) agrees to these Terms. If you do not agree, please do not install or use the App.
2. Purpose and Functionality
The App is designed to visualize human body temperature for use in home environments by lay users. Body temperature data is acquired from the SteadyTemp Patch via Near-Field-Communication (NFC). The SteadyTemp Patch is an adhesive wearable temperature sensing Patch for continuous body temperature measurement.
Specifically, the App:
- Enables you to create a local user profile (nickname or identifier);
- Optional input fields for personal information (Gender, Birthdate, Social Security Number, etc.) are available
- Reads temperature data from the SteadyTemp Patch via Near-Field-Communication (NFC);
- Allows you to enter optional information such as symptoms, medications, or notes;
- Displays temperature graphs and trends over time;
- Allows secure storage of measurement and entered data on your device or export at your discretion.
The App does not transmit identifiable or health data to SteadySense or third parties by default.
3. Intended Users and Access Control
- The App is intended for use by private individuals aged 16 years or older within a home environment. Children under the age of 12 must be supervised by a caregiver when using SteadyTemp.
- Users are responsible for maintaining the confidentiality of their device access credentials (e.g. screen lock, app PIN).
- The App must not be used to make independent medical diagnoses or replace professional medical advice.
4. Data Processing and Protection
4.1 Data Categories
During regular operation, the App may process the following data:
- User profile data (nickname or identifier);
- Optional personal information provided by the user
- Temperature data from the connected Patch;
- Optional user notes (symptoms, medication, cycle, well-being);
- Technical data (device type, app version, error logs).
4.2 Processing and Storage
- All personal and health-related data are processed locally on your mobile device.
- No automatic transmission to SteadySense or third parties occurs.
- If a research configuration is explicitly enabled (see Section 4.3), encrypted data is transferred to SteadySense’s internal servers located within the European Economic Area (EEA).
4.3 Research Configuration (Optional)
The App contains a research configuration that can be enabled for specific clinical investigations or research projects (e.g. clinical studies, validation trials). This research configuration can only be enabled on an individual device level by research personnel following instructions provided by SteadySense. This research configuration cannot be activated without user consent.

4.4 Security
SteadySense applies technical and organizational measures consistent with state-of-the-art security standards, including:
- Local data encryption;
- Secure device authentication;
- TLS-encrypted communications where applicable;

4.5 Firebase Services (Remote Config and Analytics)
The App uses Firebase Remote Config and Firebase Analytics, both provided by Google Ireland Ltd., to ensure correct regional configuration and to gather anonymous usage statistics.
- Firebase Remote Config enables the App to display region-appropriate information, such as the correct Instructions for Use (IFU), and to configure features based on regulatory region.
- Firebase Analytics records only non-personal usage information, such as screen visits, session duration, and button clicks, to help SteadySense improve the App’s performance and usability.
No health data, user-entered information, or personal identifiers are transmitted through these services. All Firebase data are processed in accordance with the EU General Data Protection Regulation (GDPR) and Google’s Data Processing Terms.

5. License and Usage Rights
SteadySense grants you a non-exclusive, non-transferable, revocable license to install and use the App on your personal device solely for your private, non-commercial use.
You may not:
- Modify, reverse-engineer, or decompile the App;
- Circumvent technical protection mechanisms;
- Use the App for commercial, diagnostic, or research purposes without written approval from SteadySense;
- Copy, distribute, or sublicense the App or any part thereof.
All rights not expressly granted remain the property of SteadySense GmbH.
6. Liability and Warranty
6.1 General
SteadySense provides the App in accordance with applicable medical-device safety standards. The App is intended solely as a supporting tool to measure human body temperature and is not a substitute for medical diagnosis or treatment.
6.2 Exclusion of Liability
SteadySense is not liable for:
- Use of the App or Patch outside their intended purpose;
- Incorrect application of the Patch or failure to follow the Instructions for Use (IFU);
- Malfunctions resulting from the user’s device, operating system, or connectivity;
- Consequences of misinterpretation of temperature data or health trends.
6.3 Limitation of Liability
SteadySense’s liability is limited to damages resulting from gross negligence or intent. Liability for injury to life, body, or health remains unaffected. SteadySense shall not be liable for indirect or consequential damages, such as data loss or device malfunction.
7. Updates, Maintenance, and Availability
SteadySense may release updates to improve safety, security, or performance. Users should install updates promptly to ensure correct functionality.
While SteadySense strives for high App availability, uninterrupted use cannot be guaranteed. Temporary interruptions may occur due to maintenance or technical issues.
8. Intellectual Property
All rights, titles, and interests in the App — including software, design, documentation, and trademarks — remain the exclusive property of SteadySense GmbH. No ownership rights are transferred to the user.
9. Confidentiality
SteadySense and its employees treat all research-related and technical information as confidential. In its default configuration, the App operates entirely locally — no personal or health data are transmitted outside of the user’s device. Data remain fully under the user’s control at all times.
Only if the research configuration is enabled for approved clinical investigations encrypted data is transferred to secure SteadySense servers within the European Economic Area (EEA). For users participating in such research activities, data handling is governed by the respective research data-processing agreement and study-specific informed consent forms.
10. Termination
SteadySense may terminate the license or access to the App if:
- You breach these Terms;
- The App is used in a way that compromises safety or violates applicable law; or
- Regulatory requirements necessitate product changes or withdrawal.
Upon termination, you must delete all copies of the App from your device.
11. Applicable Law and Jurisdiction
These Terms are governed by Austrian law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The competent court in Graz, Austria, shall have exclusive jurisdiction, except where mandatory consumer protection provisions stipulate otherwise.
12. Severability
If any provision of these Terms is or becomes invalid, the remaining provisions shall continue in full force. The invalid clause will be replaced by a valid one that best reflects the original intent.
