SteadyTemp Professional App – Terms of Use
1. Scope and Applicability
These Terms of Use (“Terms”) govern the use of the SteadySense Professional mobile application (“App”) provided by SteadySense GmbH, Johann-Schreiner-Strasse 3, 8074 Raaba-Grambach, Austria (“SteadySense”, “we”, “our”, “us”).
The App is intended exclusively for professional use within healthcare facilities and must be operated in accordance with applicable medical, data protection, and IT security regulations. These terms apply to all institutions, healthcare professionals, and users who install or use the App as part of patient monitoring workflows.
By installing or using the App, the user and the employees of the healthcare institution accept these Terms.
2. Purpose and Functionality
The App is designed to interact with the adhesive wearable temperature sensing SteadyTemp Patch for the purpose of continuous measurement of human body temperature in a clinical environment.
Specifically, the App:
- Allows users (e.g. nurses, physicians) to identify patients by scanning their hospital wristband;
- Acquires body temperature data from the connected SteadyTemp Patch via Near-Field-Communication (NFC);
- Optionally allows manual entry of additional vital parameters (e.g. blood pressure, heart rate, SpO₂, glucose);
- Optionally allows user authentication (via OAuth2)
- Transmits all collected data securely to a defined endpoint (FHIR-compliant system) over HTTPS, unless configured otherwise by the healthcare facility’s IT administrator.
The App does not transmit any personal data to external parties, cloud services, or analytics platforms (e.g. Google Analytics, Firebase, or social media). It operates solely within the IT network configured by the healthcare facility’s IT administrator.
3. Intended Users and Access Control
- The App is intended solely for qualified healthcare professionals (e.g. nurses, doctors, clinical IT staff).
- Configuration of network endpoints and data transmission settings is performed by the healthcare facility’s IT administrator.
- Unauthorized use or installation outside the hospital environment is strictly prohibited.
- If operator authentication is configured, users are responsible for maintaining the confidentiality of their authentication credentials and access rights.
4. Data Processing and Protection
4.1 Data Categories
The App may process the following personal data during operation:
- Patient Identifier or encounter ID (from patient wristband);
- Continuous temperature data;
- If configured, manually entered vital parameters;
- Technical metadata (e.g. device ID, timestamps, transmission logs).
4.2 Roles and Responsibilities
Under GDPR:
- The healthcare facility is the data controller and determines the purpose and means of processing;
- SteadySense GmbH acts as a data processor and processes data only on the hospital’s behalf, according to a written Data Processing Agreement (DPA).
4.3 Transmission and Storage
- All communications between the App and healthcare facility servers are TLS-encrypted, unless configured otherwise by the healthcare facility’s IT administrator.
- Data remain within the healthcare facility’s IT environment and are not stored on the App once transmitted.
- SteadySense does not access, analyze, or forward patient data to third parties.
4.4 Security
SteadySense implements state-of-the-art technical and organizational security measures to protect data integrity and confidentiality, including secure transmission, authentication, and access logging.
5. License and Usage Rights
SteadySense grants the healthcare facility a non-exclusive, non-transferable license to use the App within its clinical environment for the duration of the hospital’s license agreement or service contract.
The healthcare facility and its users may:
- Install and use the App on designated devices;
- Use the App solely for patient monitoring within approved healthcare facility workflows.
It is prohibited to:
- Modify, reverse-engineer, or decompile the App;
- Use the App outside approved healthcare facility infrastructure;
- Copy or redistribute the software;
- Integrate the App into systems or services without SteadySense’s prior written approval.
6. Liability and Warranty
6.1 General
SteadySense provides the App in accordance with applicable medical device and software safety standards. However, the App is intended as a supporting tool for healthcare professionals and does not replace clinical judgment.
6.2 Exclusion of Liability
SteadySense is not liable for:
- Misuse of the App outside its intended purpose;
- Incorrect configuration or handling by healthcare facility IT staff or users;
- Errors arising from the healthcare facility’s network, hardware, or external software systems;
- Consequences of incomplete or delayed data transmission caused by local IT infrastructure.
6.3 Limitation of Liability
SteadySense’s liability is limited to damages resulting from gross negligence or intent. Liability for injury to life, body, or health remains unaffected. Under no circumstances shall SteadySense be liable for indirect, incidental, or consequential damages, including data loss or operational interruption.
7. Updates, Maintenance, and Availability
SteadySense may periodically provide updates or patches to ensure security and functionality. Healthcare facilities are responsible for installing updates promptly.
SteadySense strives for high availability of the App but does not guarantee uninterrupted operation, especially where downtime is due to healthcare facility network issues or maintenance.
8. Intellectual Property
All rights, titles, and interests in the App, including software, design, documentation, and trademarks, remain the exclusive property of SteadySense GmbH. No ownership rights are transferred to the user or healthcare facility through use of the App.
9. Confidentiality
All parties involved in data processing (healthcare facility and SteadySense) are bound by confidentiality obligations regarding any personal or patient-related information obtained during App operation. Healthcare facility staff must handle patient identifiers and health data strictly in accordance with internal healthcare facility privacy rules and applicable law.
10. Termination
SteadySense may suspend or terminate the healthcare facility’s license in cases of:
- Breach of these Terms;
- Use of the App outside approved environments;
- Termination or expiration of the healthcare facility’s service contract with SteadySense.
Upon termination, all installations of the App must be deactivated and removed from healthcare facility devices.
11. Applicable Law and Jurisdiction
These Terms are governed exclusively by Austrian law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The competent court in Graz, Austria, shall have exclusive jurisdiction, except where mandatory provisions of local law provide otherwise.
12. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force. The invalid clause will be replaced by one that most closely reflects its intended meaning in a lawful manner.
